Ready For Divorce But Don’t Want An All Out War? Domestic Mediation
The answer is a very simple and cost effective solution: Domestic Mediation. Domestic mediation has been around for a very long time but has only recently gained attention as a reasonable and more cost effective alternative to prolonged, emotional, and expensive litigation.
The process is very simple. You and your spouse agree on a domestic mediator and meet at his or her office. There are typically three sessions that last two hours. During this process, the mediator will help the couple agree to terms that work for them in dividing their assets, deciding on support, and settling custody disputes. At the end those agreements are memorialized in a contract between the parties and can be filed with the court.
The advantages are obvious. First, as stated above most of these issues can be worked out in 6 hours. Imagine the cost savings. Six hours of mediation versus two years of litigation between two attorneys billing by the hour. Aside from the savings, one great benefit of this process is that the husband and wife get to come up with their own solutions—not a judge who you have never met. Who knows your life, your kids, and your finances better than you?
For years, studies have shown what we already know to be true: that divorce and custody disputes are very difficult for families and cause serious and immediate problems for both spouses and children being able to cope in their new environment. However, recent studies now indicate that it is not the divorce per se that causes the problem, but rather the lengthy adversarial process that creates the conflict and emotional toll. Domestic mediation is specifically designed to side-step much of that conflict.
