House Republicans File Obama Immigration Lawsuit
Speaker of the House John Boehner (R-OH) told reporters that his fellow House Republicans would file an Obama immigration lawsuit against the President’s immigration policies. The Obama immigration lawsuit follows from similar suits filed by more than 25 state attorneys general. These suits claim that the President overstepped his Constitutional authority by issuing executive orders that protected millions of undocumented immigrants from deportation procedures.
Executive Orders Spur Obama Immigration Lawsuits
The Obama immigration lawsuits stem from executive orders the President issued last November. These orders allow immigration officials to take “deferred action” on nearly 5 million potential deportation cases. The Obama immigration lawsuit claims that the President exceeded his authority by issuing an order that would offer amnesty to minor children brought illegally into the U.S. by their parents. The suit also claims that the President was not authorized to state that undocumented immigrants would be allowed to obtain work permits if they did not have a criminal record.
Hearings Underway In States’ Obama Immigration Lawsuit
Preliminary hearings have already started for the states’ Obama immigration lawsuit. The suit, led by current Texas Governor and former state Attorney General Greg Abbott, got underway in Brownsville, Texas on January 15. The attorneys general, almost all of them Republicans, of nearly half the states in the Union have joined in the Obama immigration lawsuit. Some of the states, such as Texas and Arizona, have had decades of issues in dealing with undocumented immigrants. Others in the suit, such as Idaho, Nebraska, and Maine, have had fewer dealings with such issues.
Obama Immigration Lawsuit About “Rule of Law”
Despite the apparently political nature surrounding the Obama immigration lawsuits, both the states and the House Republicans maintain that the primary issue surrounding the case involves preserving the “separation of powers” clause in the U.S. Constitution. Speaker Boehner told Fox News that the Obama immigration lawsuit is about “the President violating the Constitution (and) his oath of office” and called the executive orders an “overreach” of the powers of his office.
Will Obama Immigration Lawsuits Work?
A White House spokesman said that the Obama immigration lawsuits will not be effective at stopping the current policy. The spokesman told reporters that the President acted within his Constitutional limits and compared the Obama immigration lawsuit to another case, now stalled in the courts, that House Republicans filed regarding the Affordable Care Act. The spokesman said that the opposition party appears to be depending “more and more on the courts…to challenge the President’s authority”
