Two recent medical malpractice victims have won multi-million-dollar verdicts against the doctors who injured them. An Indiana woman won a $9.4 million verdict against two Illinois weight loss doctors after their procedures left her paralyzed and mentally challenged. The family of a Florida medical malpractice victim was awarded $7.5 million after a jury found two surgeons guilty of malpractice when the family’s mother bled out during surgery.
Details of Indiana Medical Malpractice Victim Trial
A medical malpractice victim who sought out a weight loss surgical procedure won a $9.4 million verdict for her injuries. Kathryn Parker of Michigan City, Indiana, 52, contacted LifeWeigh Bariatrics, a clinic that specializes in lap band surgery. Ms. Parker met with Drs. Jeffrey Rosen and Allen Mikhail in their suburban Chicago clinic. According to the medical malpractice victim’s lawsuit, the doctors prescribed Ms. Parker a blood thinner after her surgery, which led to severe bleeding.
Medical Malpractice Victim Injuries
Ms. Parker’s bleeding from the anticoagulant was complicated by other medications she had been taking. The combination of these medications led to a loss of blood flow to her brain. She now suffers from paralysis and cognitive disabilities. She is also unable to care for herself and relies on her two sisters for around-the-clock care.
Indiana Limits Medical Malpractice Victim Awards
Ms. Parkers case was tried in Illinois, where medical malpractice victims do not need to deal with a cap on damage awards. Ms. Parker’s attorney told reporters that, if the case had been tried in Indiana, the medical malpractice victim’s award would have been limited to $1.25 million, an amount that would not have covered her medical costs to this point. Ms. Parker also received a $5 million settlement from Advocate Good Samaritan, the hospital where the surgery occurred.

Florida Family Loses Mother As Medical Malpractice Victim
A Florida mother who underwent a surgical procedure on her skull became a medical malpractice victim when she bled out during surgery. Maria Elena Espinosa, 45, was diagnosed with a two-inch tumor in her skull in 2009. The surgeons, Drs. Basil M. Yates and Pedro Albanes, recommended surgery to remove the tumor, rather than the standard treatment of radiation and chemotherapy. The attorney for Ms. Espinosa’s family stated that the doctors ignored signs that the patient was showing signs of excessive bleeding during the surgery.
Medical Malpractice Victim’s Family Awarded $7.5M
The attorney told reporters that the doctors “took her straight to surgery for (an operation) she just did not need.” The jury awarded the family of the medical malpractice victim $7.5 million. The family of the medical malpractice victim also reached confidential settlements with the anesthesiologist and internist who participated in the operation. Both surgeons are expected to file appeals of the verdict.
