Thousands of Motorists Join GM Recall Lawsuit

A recent recall on some General Motors vehicles has led to thousands of motorists considering lawsuits against the company. The recall involves faulty ignition switches that can, according to the recall announcement, “move out of the ‘run’ position, resulting in a partial loss of electrical power and turning off the engine”. At least two motorists have filed a GM recall lawsuit against the company, with thousands more expected to follow.

The recall affects several models from model years 2003 to 2007. The models include Chevrolet Cobalts and Pontiac G5s from 2005 to 2007, Saturn Ions from 2003 and 2007, Chevrolet HHRs and Pontiac Solstices from 2006 and 2007, and Saturn Sky vehicles from 2007. The company estimates that the number of vehicles under the recall could total more than 1.3 million. The large number of affected vehicles could leave the company open for potentially thousands of motorists filing GM recall lawsuits.

If the switch undergoes a jolt or impact, such as from poor road conditions or accidental jarring, the vehicle may lose power. A GM recall lawsuit may also cite that the loss of power can result in the failure of the vehicle’s airbags to deploy during an accident, which can result in injuries or fatalities to the driver and passengers. The faulty ignition switch has reportedly led to the death of at least a dozen motorists. The recall notice also states that the added weight of a key fob or key ring can increase the risk of the switch moving out of the “run” position.

The recall notice on the GM website advises drivers to remove all additional weights from their ignition keys, such as key fobs and key rings, to reduce the risk of an incident before taking the vehicle in as part of the recall. With so many deaths and injuries linked to the problem, as well as the possibility of airbag failure in the event of an impact, some experts are recommending that motorists find other options rather than risk driving the affected vehicles.

Another issue arising from the recall involves how the company handled the news of the faulty switches, both before and after the company’s 2009 reorganization. A story in Automotive News states that the current General Motors corporation is a different legal entity than the one that went into bankruptcy protection and, as such, is not liable for the issues that occurred before the reorganization. Legal observers of the GM recall lawsuit believe that the company’s new organizational structure makes no difference, as both entities engaged in activities to cover up the faulty switch until it was revealed in February 2014.
